For Lead gen companies: In light of the FCC's upcoming one-to-one consent rule, which will take effect on January 27, 2025, what steps are companies who use typeform taking into place? 

There seem to be some limitations currently with typeform and no updates or mention from their end on the new laws, so curious to get feedback from the rest. Similar to this post:

In light of the FCC's upcoming one-to-one consent rule, which will take effect on January 27, 2025, how is typeform allowing companies to continue to be compliant? 

With the new 1:1 consent rules, there is requirement to populate the terms with the name of the lead buyer. Will there be a way to send an API post before submitting the form to dynamically populate (fetch) the name of the lead buyer in the terms in order to be complaint? 

  1. Allowing for post / retrieval to systems before form is submitted to retrieve who the buyer is once the form information has been captured
  2. An easy way for the consumer to provide their signature or agreement, such as a checkbox or e-signature with the marketing partners disclosed 
  3. Automatic documentation to prove the user’s consent. Some companies like Trusted Form offer playback, is this something Typeform will support or how else will they ensure that the consent captured by users is compliant with standards? Relying on the TF results page / Webhook submissions may not suffice..

@Rubbi2023 - some of the requirements are on us as the owners of the specific forms and business processes in which they exist, to ensure compliance. granted Typeform needs to assist with their tooling but it is not solely on Typeform

@Rubbi2023  - btw… the interpretation of this regulation coming into effect focuses on consent for robocalls/robotexts and not so much for email. 

 

What are the main requirements under the FCC’s TCPA one-to-one consent rule?

The FCC’s TCPA one-to-one consent rule includes several key requirements:

Individual record of consent by each lead buyer

  • Each advertiser must obtain and retain appropriate prior express written consumer consent if robocall/robotext technology will be used in the marketing sales outreach.

    • This is perhaps the most important change in new requirements for the TCPA update. The advertiser is now the one that bears nearly all of the legal and financial risk in an inquiry or TCPA lawsuit.

Will typeform implement any adjustments to help companies stay compliant?

Specifically, will there be a way to send an API post before submitting the form to dynamically populate (fetch) the name of the lead buyer in the terms in order to be complaint?
